ACKNOWLEDGEMENT AND ACCEPTANCE OF TERMS OF USE

This statement is required as per Nevada State Assembly Bill 295 because Trivedi Global, Inc. (Trivedi¹) fits with Nevada’s guidelines for wellness companies. It is recommended that before beginning any wellness plan, you notify your primary care physician or other licensed providers of health care of your intention to use wellness services, the nature of the wellness services to be provided and any wellness plan that may be utilized. It is also recommended that you ask your primary care physician or other licensed providers of health care about any potential drug interactions, side effects, risks or conflicts between any medications or treatments prescribed by your primary care physician or other licensed providers of health care and the wellness services you intend to receive.

Neither Trivedi nor you shall be responsible for damages or for delays or failures in performance resulting from acts or occurrences beyond their reasonable control, including, without limitation: fire, lightning, explosion, power surge or failure, water, acts of God, war, revolution, civil commotion or acts of civil or military authorities or public enemy‘s: any law, order, regulation, ordinance or requirement of any government or legal body or any representative of any such government or legal body; or labor unrest, including, without limitation, strikes, slowdowns, picketing or boycotts; inability to secure raw materials, transportation facilities, fuel or energy shortages, or acts or omissions of other common carriers.

INDEMNIFICATION

Upon a request by Trivedi, you agree to defend, indemnify, and hold Trivedi and its other affiliated companies harmless, and their employees, contractors, officers, and directors from all liabilities, claims, and expenses, including attorney’s fees, that arise from your misuse of this site.

SEVERABILITY AND INTEGRATION

Unless otherwise specified herein, this agreement constitutes the entire agreement between you and Trivedi with respect to this site and supersedes all prior or contemporaneous communications between you and Trivedi with respect to this site. If any part of these Terms and Conditions is held invalid or unenforceable, that portion shall be construed in a manner consistent with applicable law to reflect, as nearly as possible, the original intentions of the parties, and the remaining portions shall remain in full force and effect.

PAYMENT

You authorize us to charge you for use of the Services, at the posted prices, (such prices subject to change at any time by the Company without any specific notice to you, beyond posting notification on the website), at such times as you specify upon enrollment and continuing until you cancel your membership. All payments shall be made in United States dollars. You represent and warrant that: (i) any credit card or other payment information you supply is true and complete, (ii) charges incurred by you will be honored by your credit card company, and (iii) you are responsible to pay the charges incurred by you at the posted prices, including any applicable taxes.

REFUNDS

Refunds are processed according to the Policies listed below for the Programs specified. All fees and charges will be collected and refunded in US Dollars. Trivedi will not be responsible for currency Exchange Rate fluctuations.

We reserve the right to change our refund policy at any time. All policies listed below are effective immediately, including all the programs you are currently enrolled in.

EVENING OF TRANSFORMATION

Single Purchase – Your request for a refund must be submitted within 30 days from the date of the Energy Transmission.

MONTH OF TRANSFORMATION SPECIAL EVENT
MONTH OF TRANSFORMATION (3GROUP ENERGY TRANSMISSION PLUS 1 MASTER ENERGY TRANSMISSION SERIES) – Your request for a refund must be submitted within 30 days from the date of the third/last Group Energy Transmission for a full refund of the cost of a Month of Transformation Energy Transmission series.

TRIVEDI RETREATS AND WORKSHOPS

IN-PERSON – A full refund is available, if you cancel within 15 or more days remaining before the beginning of the Event. A refund of 75% is available if you cancel from 5 to 14 days before the Event begins. A 25% refund is available if you cancel within 4 days or fewer before the Retreat begins. No refunds are available once the Retreat has begun.
REMOTE– A full refund is available if you cancel 24 hours or more prior to the event starting. No refunds are available once the event has begun.
Intercessions (Remote and In-person Individual Energy Transmissions) You may request a full refund up to 24 hours before the scheduled event.

OTHER TRIVEDI PROGRAMS

For all other Trivedi Programs there are NO refunds including, but not limited to: Empowerment Program, Empowerment for Kids Program, Elevation Program, Transcendence Program (formerly known as Master Energy Transmission Programs by Mahendra Trivedi and Alice Branton, Daily Transmission Program, and Daily Transmission Program for Kids); Healers Mastery Programs – Phases 1, 2, 3 & 4 (formerly Healing Masters Programs); Monthly Enhancement Program (single and subscription options) or Intercessions (formally known as Remote Individual Energy Transmissions by Mahendra Trivedi, Dahryn Trivedi, or Gopal Nayak).

DISCOUNTED RATES Trivedi at its own discretion, reserves the right to offer discounted rates on Trivedi ¹ Programs to individuals of their choice. If anyone participates in a Trivedi Program at a discounted rate the discounts are only valid as long as you remain in the program. If you cease receiving transmissions, the discount will not be available thereafter.

PROFESSIONAL LIABILITY RELEASE, INDEMNIFICATION AGREEMENT AND IMAGE WAIVER

Purchaser (Purchaser refers to the individual, group or company purchasing the energy transmission whether that is the Purchaser of the gift or a gift recipient), in exchange for an Energy Transmission(s)(sometimes referred to as Blessings) administered by Trivedi to the Purchaser or Purchaser^’s designated gift recipient the sufficiency of which is hereby acknowledged by Purchaser and Purchaser hereby consents to the following: Section 1: PURCHASER¹ INDEMNIFIES AND FOREVER RELEASES TRIVEDI FROM ALL LIABILITY and agrees to hold Trivedi harmless for any claim, liability, and demand of any kind or description. Purchaser further WAIVES any provision of any relevant state or municipal statute or law or regulation providing that claims which are unknown by Purchaser to exist as potential claims are protected from RELEASE. Instead, Purchaser voluntarily waives, surrenders and gives up any rights under any and all such provisions and any other applicable rule, law, regulation or statute in any jurisdiction of the United States of America. Section 2: Likeness Release: Purchaser hereby further grants permission to Trivedi to use his/ her likeness in photographic or video- taped representations of him/ her, and his/ her written or spoken testimonials, in any and all of its publications and in any and all other media, whether print or electronic, and whether in full version or edited version, without further consideration in perpetuity. Purchaser acknowledges that Trivedi may crop or otherwise adjust or treat the photographic or videotaped likenesses of me, in its sole discretion, either now or in the future. Purchaser waives the right to inspect and consent to the use of likeness, video, audio or written comment in any format, known or unknown, which Trivedi may determine. Purchaser understands that images posted on a website may be seen or downloaded by any computer and acknowledges such uses of electronic media and consent to them. I further consent to the use of my words and statements in any material which Trivedi may deem appropriate, including those used for Trivedi²‘s purposes of advertising or promotion, in all media, whether print or electronic, in still photographic, or in audio or videotaped formats. Section 3: Release and Indemnity. Purchaser hereby further RELEASES and INDEMNIFIES TRIVEDI from any and all liability for any consequences of receiving an Energy Transmission/ Blessing. Purchaser acknowledges that his/ her session with Mahendra Kumar Trivedi and/or Dahryn Trivedi and/or Master Gopal and/or Alice Branton is a spiritual blessing, and does not include or relate to a medical or other evaluation, diagnosis, prescription, treatment or prognosis. It is not intended to serve as “medical care” nor to substitute for medical care provided by a licensed nurse, physician or other licensed medical or health care practitioner. Neither Trivedi, nor persons acting in concert with them or on their behalf, are licensed health care providers or practitioners, nor do they represent or hold themselves out as health care providers or practitioners. No promises or representations are made regarding the effects or outcome of this session. Purchaser assumes all responsibility for any medical condition or health condition that he/ she currently has or may have in the future. Purchaser¹ agrees that he/ she will not, based on this session, suspend, modify, or terminate any medical treatment or medical care now being received, without first consulting the health care provider prescribing treatment or responsible for that care. Purchaser understands that without this Release, Trivedi would not consent to conduct the Energy Transmission. Section 4: Governing Law. This Agreement shall be governed by and construed in accordance with the Prevailing Laws, Rules and Regulation Clark County, Nevada, USA without regard to its conflicts of law principles. The parties hereto agree that the sole jurisdiction for any disputes or claims arising between them is Clark County, Nevada. PURCHASER HAS READ THIS DOCUMENT COMPLETELY, UNDERSTANDS ITS TERMS, HAS HAD THE OPPORTUNITY TO ASK QUESTIONS BEFORE AGREEING, AND ACKNOWLEDGES THAT HE/SHE AGREES FREELY AND VOLUNTARILY.

PROFESSIONAL LIABILITY RELEASE, INDEMNIFICATION AGREEMENT AND IMAGE WAIVER INCLUDING MINOR CHILD (REN)

Purchaser, (on behalf of myself and my minor child of whom I am the Parent/and or Guardian) hereafter referred to collectively as Purchaser, in exchange for an Energy Transmission(s) (sometimes referred to as Blessings) administered by Trivedi to Purchaser the sufficiency of which is hereby acknowledged by Purchaser and Purchaser hereby consents to the following: Section 1: PURCHASER INDEMNIFIES AND FOREVER RELEASES TRIVEDI FROM ALL LIABILITY and agrees to hold Trivedi harmless for any claim, liability, and demand of any kind or description. Purchaser further WAIVES any provision of any relevant state or municipal statute or law or regulation providing that claims which are unknown by Purchaser to exist as potential claims are protected from RELEASE. Instead, Purchaser voluntarily waives, surrenders and gives up any rights under any and all such provisions and any other applicable rule, law, regulation or statute in any jurisdiction of the United States of America. Section 2: Purchaser hereby further grants permission to Trivedi to use his/ her likeness and likeness of minor child in photographic or video- taped representations of him/ her, and his/ her written or spoken testimonials, in any and all of its publications and in any and all other media, whether print or electronic, and whether in full version or edited version, without further consideration in perpetuity. Purchaser acknowledges that Trivedi may crop or otherwise adjust or treat the photographic or videotaped likenesses of me, in its sole discretion, either now or in the future. Purchaser waives the right to inspect and consent to the use of Purchaser’s (and my minor child‘s) likeness, video, audio or written comment in any format, known or unknown, which Trivedi may determine. Purchaser understands that images posted on a website may be seen or downloaded by any computer and acknowledges such uses of electronic media and consent to them. Purchaser further consent to the use of my words and statements in any material which Trivedi may deem appropriate, including those used for Trivedi’s purposes of advertising or promotion, in all media, whether print or electronic, in still photographic, or in audio or videotaped formats. Section 3: Release and Indemnity. Purchaser hereby further RELEASES and INDEMNIFIES Trivedi from any and all liability for any consequences of receiving an Energy Transmission/ Blessings. Purchaser acknowledges that his/her session or minor child‘s session with Mahendra Kumar Trivedi and/or Dahryn Trivedi and/or Master Gopal and/or Alice Branton is a spiritual blessing, and does not include or relate to a medical or other evaluation, diagnosis, prescription, treatment or prognosis. It is not intended to serve as “medical care” nor to substitute for medical care provided by a licensed nurse, physician or other licensed medical or health care practitioner. Neither Trivedi, nor persons acting in concert with them or on their behalf, are licensed health care providers or practitioners, nor do they represent or hold themselves out as health care providers or practitioners. No promises or representations are made regarding the effects or outcome of this session. Purchaser assumes all responsibility for any medical condition or health condition that she/he currently has or may have in the future. ¹As used in this Agreement, “Trivedi“ includes Trivedi Global, Inc., its current and future subsidiaries, joint ventures, affiliated companies, successors in interest, predecessors in interest, legal representatives and other agents, directors, officers, or employees, but excludes to Trivedi LLC, Trivedi Master Wellness LLC, Trivedi Products LLC, Trivedi Foundation, Dahryn Trivedi, Mahendra Kumar Trivedi, Gopal Nayak and Alice Branton.
